Personal Data Protection Decree Draft – Businesses Must Be Prepared - Blue Technology

In the digital era, personal data is considered the “digital asset” of every organization and individual. As digital transformation accelerates, protecting personal data has evolved beyond a legal obligation to become a core factor in building trust with users and partners.

The new draft extends its scope to foreign organizations and individuals processing personal data of Vietnamese citizens, demonstrating the Government’s determination to strengthen control over cross-border data collection, sharing, and storage.

The decree provides a clearer classification of personal data — including identity information, biometric data, financial data, geolocation, and online behavior — requiring businesses to manage them systematically, transparently, and securely.

In addition, organizations collecting personal data must publish a clear data protection policy, appoint a data protection officer, and notify users of the purpose of data use before processing. Non-compliance may result in serious penalties, including suspension or heavy financial sanctions.

These new regulations will significantly affect most enterprises — especially in finance, banking, telecommunications, technology, and e-commerce, where massive amounts of user data are processed daily.
